Please carefully read and review the following terms and conditions. You, the client, must agree to all of the following terms and conditions set forth before any work agreement will commence. We must receive a signed copy of the agreement before Mudbug Designs will begin any work on your project.

 

MY POLICY

 

Mudbug Designs hours of business are Monday Friday, 8:00 am to 5 pm CST, except all holidays and unless otherwise notified. We will respond to inquiries and requests during these times. If you require emergency service outside of regular business hours, call 318-523-1009 so we can discuss further. If you need emergency updating or maintenance simply submit your request via email and we will schedule your service immediately (with the fee included).

 

BILLING

 

A non-refundable 50% deposit is required to begin your design process. You will not be placed on the schedule until this deposit is paid in full. This does not apply to jobs totaling less than $200. Jobs totaling $200 or less are required to be paid in full. Once your graphic design project, print request, animation or web site is complete, final payment is due. Mudbug Designs will not release files for print, animations or make your site live until all outstanding balances are paid in full. All unpaid balances over 30 days are subject to a late fee of 10% of the remaining balance, with a minimum charge of $25.

 

If your project goes beyond schedule and over budget due to added project elements, an additional payment will need to be made before we will proceed with any work. We will then create a new invoice for the additional work to be completed.

 

PROJECT SCHEDULE & WAITING LIST

 

Once the client has paid their first initial payment, we will add them to the project schedule waiting list. Once the client's design date has arrived, the process will then take up to 6 weeks to complete, depending on the schedule and size of project. We have the right to extend the project date if need be, depending on the requests of the client or the depth of the project.

 

REFUNDS and EXCHANGES

 

Due to the digital nature of this business WE DO NOT offer refunds or exchanges. You are however allowed to cancel before any work is done to your web, animation or graphic design. 

 

Once your deposit and/or full payment has been received, your project is accepted and placed on the design schedule. No refunds are permitted under any circumstances. Your deposit is a retainer. Your deposit also covers any costs that may occur before the actual design process begins, such as hosting/domain fees, graphic fees, printing etc.

 

If you choose to place the project on hold for any length of time for any reason, a continuation fee may be required, once the project resumes. Please understand that we work from a long waiting list so please don't commit to a project if you're not 100% certain you are willing to wait. Again, this also depends on the size of the project.

QUOTE GUARANTEE

 

All written quotes are guaranteed for no less than 30 days. Your quote covers the cost of the design and the designer's billable hours, and any printing/materials that will be needed. There are no refunds or exchanges on design layout services; however Mudbug Designs will strive to achieve mutual satisfaction. If you are unhappy with your design we will make every reasonable attempt to make the changes necessary to fulfill your needs.

 

Your quote covers the cost of two (2) initial layouts if needed and four (4) revisions for the final designs. Any additional drafts will be billed according to time. I will not do unlimited layouts, backgrounds, logo designs or print layouts for the cost of your initial quote. While your ultimate satisfaction is Mudbug Designs goal, any additional drafts will be billed at the rate of $45 per hour.

 

Please be clear on your design needs, as this will save you time and money.

 

ESTIMATES

 

Prior to beginning any website or animation project Mudbug Designs will give you the best estimate on time, and budget. Please remember that this is an estimate. Estimates are guaranteed within 10%, however if the client requests work that has not been detailed in the original estimate, this work will be considered a revision and will be billed separately. If it is evident that the Client has been unclear about the needs of the project, estimates are subject to adjustment at the discretion of the designer. Billing will reflect the actual costs incurred.

 

Photos - Must be web or print ready as they relate to your project. Web ready 72 dpi. Print ready 300 dpi. Logos - Need to be in vector or high resolution format .jpg, .png, .pdf. 300 dpi. Each page or layout must be in final proof read format. While we may catch random spelling errors it is your responsibility to write, edit and approve your proof prior to the layout of your site or design. Any editing will be billed at the rate of $60 per hour.

 

All photos must be in web or print ready format as they relate to your project. Your initial quote does not cover the cost of photo enhancement. An additional fee will be incurred for any and all photo editing required. Additional fees will be charged for any photo editing including; retouching, color correction, cropping, brightening, sharpening and all other forms of cleaning up your images. We will resize photos as necessary to implement them into the design of your project. All photo editing will be billed at the rate of $35 per hour. We may also provide stock images within your design. Licensing fees will be included in your quote if needed.

 

PERMISSIONS and RELEASES

 

Client agrees that all images, text and copy provided to Mudbug Designs for inclusion into any website, animation or graphic design are property of the client or have been given permission from the rightful owner to use each of these elements, and the Client agrees to hold harmless, protect, and defend Mudbug Designs from any claim or lawsuit against Mudbug Designs arising from the use of any and all elements provided to Mudbug Designs by the Client. The Client agrees to indemnify and hold harmless Mudbug Designs against any and all claims, costs, and expenses, including attorneys fees, due to materials included in the Work at the request of the Client for which no copyright permission or privacy release was requested or uses that exceed those allowed pursuant to a permission or release.

 

REVISIONS

 

New work requested by the client after a proposal we estimated has been approved, is considered a revision. If the job changes to an extent that substantially alters the specifications described in the original estimate, both parties must agree upon a revised additional fee before further work proceeds.

 

PROJECT COMPLETION / PROJECT ABANDONMENT

 

If at any time during a project the client becomes unavailable for a period of 30 days, Mudbug Designs will consider the project completed. We will not refund.

 

COMPLETION of WORK

 

Before Mudbug Designs begins any graphic design, web design or animation project we will give you the best estimated time of completion. This estimate depends on many key factors such as but not limited to, content, functionality, and size. If the client does not provide content by the due date established in the original contract payment in full is still due. Should the client be unable to provide all content in a timely manner Mudbug Designs reserves the right to reschedule completion of your project to a later date according to our availability.

 

COMMUNICATION

 

Communication is essential to the development of your project. We agree to respond to all communications within two business days of contact. We ask that you make yourself available to respond via email to our communications within 24 hours of contact. This will ensure that your project remains on schedule and within budget. Your availability during this time is essential. If at any time during your design schedule you become unavailable and do not notify us, we reserve the right to re-prioritize your project according to our pending deadlines. This may mean that your project deadline will be delayed.

 

While we know that some clients may feel more comfortable conveying their ideas and designs over the phone, we ask that all requests for design changes be made in writing via email. This allows us to refer back to accurate correspondence during your project and will protect you and Mudbug Designs from costly design errors.

 

PORTFOLIO

 

The client agrees that your completed print work, web site, animation or custom work may be included in the portfolio or for the purpose of advertisement of Mudbug Designs.

 

CANCELLATION

 

In the event of cancellation of this assignment, ownership of all copyrights and the original artwork shall be retained by the Mudbug Designs, and a cancellation fee for work completed, based on a $35.00 per hour rate and expenses already incurred shall be paid by the client.

 

OWNERSHIP

 

Upon completion and final payment of your graphic design project, web site or animation project you will have full ownership of all images and elements used for your project. As we work through the building phase of your graphic design project, web site, animation, logo, print project or custom design you will receive proofs, versions and concepts. These preliminary proofs are NOT your property. They are the property of Mudbug Designs. They may not be used by you unless asked and agreed to.

 

EVENTS BEYOND the CONTROL of Mudbug Designs

 

We will not be liable for breach of this agreement where that breach was due to software, hardware or electrical failure, natural events such as fire or other events beyond the control of Mudbug Designs.

 

CLAIMS PERIOD

 

Claims for defects, damages, and/or shortages must be made by the client in writing to Mudbug Designs within a period of ten days after project completion. Failure to make such a claim within the stated period shall constitute irrevocable acceptance and an admission that the Project fully complies with terms, conditions, and specifications.
